The buyer is a natural or legal person who receives services from the Seller through a telephone order or through the online store at https:// cloudadventures.club/ ( hereinafter also " Internet Store " or " Portal ") and who filled out the electronic Order and sent it electronically for the purpose of ordering the service ( hereinafter referred to as the " Buyer ").

A consumer is a natural person who does not order services offered through the Internet store for the purpose of their further sale to other persons , or a natural person who, when concluding and fulfilling a purchase contract, does not act within the scope of his business activities or performance of employment or profession ( hereinafter referred to as " Consumer ").

Business relations between the Seller and the Buyer established by an order in this Internet shop according to point III. of business terms and conditions are governed by these Business Terms and Conditions, which are binding for both contracting parties.

Telephone order ( hereinafter referred to as " Order ") means the process of ordering a service , which is carried out through telephone contact between the buyer and the seller. The buyer can express his interest in purchasing the service by phone and provide the necessary information, including relevant invoicing data . The seller is entitled to record and process this data for the purposes of proper registration and execution of the order. A telephone order is binding for both parties, and the seller reserves the right to request confirmation of the order by e-mail, if he deems it necessary .

An electronic order ( hereinafter also referred to as " Order ") means an electronic form located on the website of the Internet store sent electronically by the Buyer for the purpose of ordering the service , which , among other things, contains information about the Buyer according to point III. business conditions .

The services provided by the Seller are mainly understood as: a) Sightseeing Flights (at night), b) Test pilots , c ) Air Taxi, d) Acrobatic flight ( hereinafter referred to as " Services ").

The Service is provided directly by the Seller, or by other providers through the Seller who are authorized to perform the Services in accordance with the relevant legislation of the Slovak Republic (in particular, Act No. Act No. 143/1998 Coll. on Civil Aviation (Aviation Act ) and on amendments to certain laws ( hereinafter referred to as " Other Providers ").
II. Provision of services
1. Subject and provision of services :
a) The seller provides special types of services called "Sightseeing flights (at night)", "Test pilot", "Air Taxi" and "Acrobatic flights", which are private plane rental with a pilot and flights behind walls Incurred costs ( hereinafter referred to as "Services " ) .
b) The services are described and specified in more detail on the Seller's Internet store in the section Sightseeing flights (at night), "Test pilot", "Air Taxi" and "Acrobatic flights".
2. Reservation and conditions:
a) After ordering the Services , the Buyer receives from the Seller a separate agreement on the reservation of the Services , which is bound by these terms and conditions.
3. Cancellation of Services :
a) If the Buyer cancels / cancels the individually agreed Special Service , he is obliged to pay the Seller all costs for the reservation of the Services . More in section VI. Business conditions .
b) The costs for the reservation of the Services include the costs associated with the reservation of the plane, the reservation of the pilot, the accommodation of the pilot, airport fees and other fees that required payment in advance to the provider .
4. Calculation of costs:
a) The Seller is obliged to bill the Buyer for the costs of the reservation of the Services no later than 5 days after the cancellation of the Special Services .
II. Provision of services
1. Subject and provision of services :
a) The seller provides the following special types of services : "Sightseeing flights (at night)", "Test pilots " , "Air Taxi" and "Acrobatic flights". These services are provided through the rental of a private plane with a pilot and flights for shared costs .
b) The seller can lease aircraft from other providers and share the costs with these providers , which are invoiced by the buyer or included in the service price .
2. General terms of services :
a) Services are provided in accordance with all valid regulations , rules and safety standards in aviation .
b) The seller reserves the right to refuse to provide the service if there is a reasonable assumption that it could pose a danger to the health or safety of the customer or other persons .
III. An order
1. Service order :
a) The buyer can order the service through the seller's online store or by phone. .
b) The order for services is considered binding for the buyer and the seller, and only when it is confirmed by the seller.
2. Order data:
a) The buyer is obliged to provide accurate and valid data when ordering the service . If the provided data is invalid or inaccurate, the seller reserves the right to cancel the order .
IV. Terms of payment
1. Price and payment:
a) The buyer is obliged to pay the agreed price for the provided services according to the invoice issued by the seller.
b) Payment can be made by bank transfer or another agreed form.

2. Rejection of payment:
a) The seller reserves the right to refuse to accept payment if there are suspicions of unauthorized or illegal activity on the part of the buyer.
b) If the payment from the buyer has been refused, the seller reserves the right to cancel the order or suspend the provision of the service , without clarifying the situation.
V. Cancellation and change of order
1. Order cancellation :
a) The buyer has the right to cancel the service order no later than 24 hours before the scheduled date of service provision .
b) Order cancellation must be delivered to the seller by phone or electronically (online form or email).
2. Order change:
a) The buyer can request to change the order no later than 24 hours before the scheduled date of service provision .
b) The seller reserves the right to accept or reject the request to change the order and informs the buyer of his decision.
VI. Cancellation / Complaints
1. Cancellation of services :
a) If the buyer cancels the ordered service , he may be charged a cancellation fee that covers the costs associated with the reservation and any losses of the seller.
2. Claims:
a) If the buyer has objections or complaints regarding the service provided , he is obliged to notify the seller of these objections in a reasonable time .
b) The seller undertakes to deal with the complaint within his capabilities and in accordance with applicable regulations .
VII. Gift cards
1. Gift voucher :
a) A gift voucher is valid for one calendar year from the date of its issue, unless otherwise stated.
b ) Each gift voucher is marked with a specific code , which is unique and can only be used once .
c) To redeem a gift voucher , it is necessary to fill out the form on our website or make a telephone reservation and enter the relevant code of the gift voucher .
2. Application of a gift check voucher :
a) The buyer of the voucher gift is responsible for using the voucher within its validity period.
b) A gift voucher can only be used once and cannot be returned or exchanged for cash .
c) In the event that the value of the provided service exceeds the value of the gift voucher , the buyer is obliged to pay the difference.
3. Validity and reservation:
a) The gift voucher is valid for one calendar year and its validity cannot be renewed or extended .
b) Reservation of services with a gift voucher is required in advance and can be done by filling out the form on our website or by contacting us by phone .
4. Delays and losses:
a) The seller is not responsible for the loss or delay of the gift voucher resulting from unauthorized use or negligence on the part of the buyer.
5. Changes and cancellation:
a) Changes to the reservation or cancellation of the order with a gift voucher can be made in accordance with the business terms and conditions regarding cancellation and change of the order stated above .
b ) These terms and conditions for gift vouchers are part of the general terms and conditions and apply to all gift vouchers issued by our company .
VIII. Liability for damage to property and health
1. Responsibility :
a) The seller is not responsible for any damage to property or health that occurred when using the provided services , unless they are caused by the seller's negligence or intentional actions .
b) The seller rejects any responsibility for damages that arise as a result of improper use of the provided services by the buyer, including violation of instructions and safety measures .
2. Limitation of liability:
a) In the event that the seller bears responsibility for the damage , his responsibility will be limited to the amount paid by the buyer for the services provided .
b) The seller is not responsible for indirect, consequential or extraordinary damages , including loss of profit, loss of business opportunities or reputational damage .
3. Acceptance of risk:
a) The buyer acknowledges and agrees that the provision of certain services , such as aerobatic flights , may be associated with certain risks and that they participate in does not voluntarily expose these services to such a risk.
4. Delay or failure:
a) The seller is not responsible for any delay or failure in the provision of services caused by unforeseen circumstances , such as adverse weather conditions, technical malfunctions of the aircraft, traffic restrictions or other factors beyond its control.
5. Exclusions of liability:
a) These terms and conditions do not limit or exclude the responsibility of the seller in the event that it is in conflict with applicable legal regulations, including responsibility for intentional actions, death or personal injury caused by the negligence of the seller.
6. Apply the legal regulations :
a) If any provision of these business conditions proves to be invalid or unenforceable by law , this will not affect the validity or enforceability of the other provisions .
7. Relationship between the parties:
a) The relationship between the buyer and the seller is governed by these terms and conditions and the applicable legal regulations of the Slovak Republic.
8. Relevant legal regulations:
a) All disputes between the buyer and the seller arising in connection with these business conditions will be subject to the jurisdiction of the relevant courts of the Slovak Republic and will be resolved in accordance with applicable legal regulations.
These terms and conditions enter into force at the moment of confirmation of the order by the seller and are valid for the entire period of service provision .
